Terms and conditions

Article 1 – Definitions

  • General Terms and Conditions: these general terms and conditions of Solar Guard Exclusive Truck Parts B.V.

  • Login details: the combination of username and password of the Customer for the B2C shop.

  • Customer: the natural person or legal entity placing an order via the B2C website.

  • Solar Guard: the private limited company Solar Guard Exclusive Truck Parts B.V., located at Zekkenweg 80, 3151 ZC Hoek van Holland.

  • Agreement: the agreement concluded via the B2C website, under which the Customer purchases products from Solar Guard.

  • Product: a product offered on the B2C website by Solar Guard.

  • Website: the B2C website of Solar Guard where Products are offered.

  • Privacy Policy: the privacy statement of Solar Guard, as published on the Website.

Article 2 – Applicability

These Terms apply to every offer on the Website, the use of the Website, and every Agreement concluded with Solar Guard.
Solar Guard may amend these Terms. Amendments do not apply to Agreements already concluded. The latest version is always available on the Website.
Customer’s general terms and conditions are explicitly excluded.

Article 3 – Offer and conclusion of the Agreement

Offers on the Website are non-binding. Solar Guard may revoke an offer immediately after an order is placed.
The Agreement is concluded once the Customer completes the order process and accepts these Terms.
Obvious mistakes or errors are not binding on Solar Guard.

Article 4 – Use of the Website

Solar Guard does not guarantee that the information on the Website is always correct, up to date or complete.
The Customer ensures that all account information provided is correct and up to date.
The Customer is responsible for all actions with their Login details.
In case of loss or misuse, the Customer must inform Solar Guard immediately.

Article 5 – Price and payment

Prices are exclusive of VAT (unless otherwise stated). Shipping or additional costs are listed separately.
Payment is made immediately during the order process via the payment methods offered by Solar Guard.

Article 6 – Delivery

Delivery times are indicative only.
Orders may be delivered in partial shipments.
Risk transfers to the Customer once the Products are handed over to the carrier.

Article 7 – Privacy

Data provided by the Customer will be processed in accordance with the Privacy Policy and applicable privacy laws (GDPR).

Article 8 – Withdrawal and complaints

Returns are only possible under the conditions described in Shipping & Returns.
Complaints must be reported in writing within five (5) days of delivery.
Solar Guard will respond within a reasonable timeframe.

Article 9 – Conformity and warranty

Products must conform to the Agreement. In case of non-conformity, Solar Guard will offer repair, replacement, or (partial) refund.
No claims can be made if the Customer was aware of the defect when concluding the Agreement.

Article 10 – Liability

Solar Guard is not liable for indirect or consequential damages.
Liability is limited to the invoice amount of the order.
Nothing excludes liability for intent or gross negligence.

Article 11 – Force majeure

Solar Guard is not obliged to fulfil obligations if prevented by force majeure.
In case of permanent impossibility, both parties may dissolve the Agreement without damages.

Article 12 – Final provisions

Rights and obligations cannot be transferred by the Customer without written consent.
Dutch law applies exclusively.
Disputes will be submitted to the competent court in Rotterdam, unless mandatory law provides otherwise.
